Samo Skupština Opštine Srebrenica ima legalno pravo donijeti odluku o otcjepljenju od genocidne tvorevine "Republike Srpske" na osnovu presude Internacionalnog suda pravde od 26. februara 2007. Takvu odluku u ime Srebrenice ne može donijeti niti jedna druga institucija u svijetu, niti Savjet Bezbjednosti Ujedinjenih Nacija, niti genocidom stvorene institucije u Daytonskoj BiH, uključujući i Skupštinu Daytonske BiH.

Niko u svijetu, uključujući i genocidom stvorene institucije Daytonske BiH, ne može osporiti pravo Opštini Srebrenica na restauraciju pravnog sistema kakav je bio prije agresije i genocida. To pravo Opštini Srebrenica garantuje Presuda Internacionalnog suda pravde protiv Srbije i genocidne tvorevine "Republike Srpske". To je ono što su Profesor Francis A. Boyle i Carla Del Ponte izborili za Bosnu i Hercegovinu i Srebrenicu na Internacionalnom sudu pravde i na Internacionalnom tribunalu za ratne zločine u bivšoj Jugoslaviji.

Svaki onaj koji tvrdi kako je neko drugi u svijetu dužan da donese takvu odluku u ime Srebrenice, a ne Skupština Opštine Srebrenica, je neznalica ili izdajnik, uključujući i one političare koji tobože podržavaju interes Srebreničana, a svu odgovornost za budućnost Srebrenice i Bosne i Hercegovine stavljaju na pleća nekog apstraktnog svijeta, i sve cine da jedina legitimna institucija, a to je Skupština Srebrenice ne donese takvu odluku.

Na zahtjev predstavnika Opštine Srebrenica, Profesor Boyle, otac tužbe Republike BiH protiv Srbije i Crne Gore za genocid počinjen u Republici BiH, je pripremio za Skupštinu opštine Srebrenica, na osnovu normi internacionalnog prava, Odluku o odcjepljenju od genocidne "Republike Srpske" pod nazivom "DEKLARACIJA NEZAVISNOSTI SREBRENICE, OPŠTINE REPUBLIKE BOSNE I HERCEGOVINE". Na zahtjev predstavnika Opštine Srebrenica, u nastavku prenosimo originalni tekst Deklaracije na Bosanskom i Engleskom jeziku.




DEKLARACIJA NEZAVISNOSTI SREBRENICE, OPŠTINE REPUBLIKE BOSNE I HERCEGOVINE


Skupština opštine Srebrenica na svojoj sjednici održanoj __ marta 2007 proglašava da je Srebrenica od ovog datuma pa nadalje NEZAVISNA OPŠTINA REPUBLIKE BOSNE I HERCEGOVINE u okviru Bosne i Hercegovine.

U skladu sa planom da se podijeli Republika Bosna i Hercegovina u “Generalnom okvirnom sporazumu za mir u Bosni i Hercegovini”, koji je zvanično potpisan u Parizu u decembru 1995. (u daljem tekstu “Pariški sporazum” ili “Dejtonski sporazum”), Srebrenica i njen narod su bili žrtvovani. Nad narodom Srebrenice je bio počinjen genocid. Ovo je potvrđeno odlukom Internacionalnog suda pravde od 26. februara 2007. godine, kojom je presuđeno da je Srbija kriva što nije spriječila genocid u Srebrenici kojeg je počinila vojska Republike Srpske.

Pariški sporazum i Republika Srpska uspostavljena tim sporazumom je izgrađena na genocidu počinjenom u Srebrenici. Bez genocida u Srebrenici ne bi bilo Pariškog (tj. Dejtonskog) sporazuma i zato je taj sporazum nelegalan i nevažeći. Republika Srpska, koja je formirana Pariškim (tj. Daytonskim) sporazumom je stoga genocidna državica bez bilo kakvog legalnog osnova. Budući da su zasnovani na genocidu mi ih obadvoje i sporazum i Republiku Srpsku odbacujemo. Stoga, mi narod Srebrenice proglašavamo nasu nezavisnost i od genocidne Republike Srpske i od Dejtonskog sporazuma. Mi smo uvijek bili i dalje ostajemo lojalni Republici Bosni i Hercegovini. Naša jedina lojalnost je prema Republici Bosni i Hercegovini i njenom Ustavu. Stoga, mi ponovo uspostavljamo zakone i Ustav Republike Bosne i Hercegovine.


Republika Bosna i Hercegovina nikada nije bila na legalan način ukinuta i zbog tog razloga su Republika Bosna i Hercegovina i njen Ustav još uvijek na snazi ovdje u Srebrenici. Mi, narod Srebrenice ćemo primjenjivati zakone i Ustav Republike Bosne i Hercegovine i koristićemo zastavu Republike Bosne i Hercegovine. Mi ostajemo dio države Bosne i Hercegovine u statusu sličnom kao što je Brčko Distrikt, ali ćemo mi primjenjivati zakone Republike Bosne i Hercegovine.

HISTORIJA

Od početka agresije na Republiku Bosnu i Hercegovinu u aprilu 1992. do februara 1993. odbrambene snage Republike BiH u Srebrenici su uspješno odolijevale agresiji iz Srbije I Crne Gore ( krnje Jugoslavije). Procjenjuje se da je u tome periodu 1800 stanovnika Srebrenice, uglavnom civila, ubijeno kao žrtve “etničkog čišćenja”. Poslije velike ofanzive koju su vodila tri korpusa Jugoslavenske narodne armije (JNA) iz Srbije početkom februara 1993. godine, u Srebrenicu su stigle snage UNPROFOR-a. Savjet sigurnosti Ujedinjenih nacija je usvojio rezoluciju S/RES/819 kojom je uspostavljena UN zaštićena zona Srebrenica i sporazum o demilitarizaciji je bio potpisan. Nažalost “demilitarizacija” je praktično značila samo razoružavanje branitelja Srebrenice, a ne i agresorskih snaga.

Rezultat razoružavanja Srebrenice je da je u Julu 1995 godine UN zaštićena zona Srebrenica postala najveće stratište u Evropi poslije Drugog svjetskog rata, gdje je oko 8500 muškaraca, žena i djece bilo brutalno ubijeno.

Poslije toga, u “Opštem okvirnom sporazumu za mir u Bosni i Hercegovini” dogovorenim u Dejtonu, Ohio, Sjedinjene Američke Države, a čija je zvanična finalna verzija bila potpisana u Parizu, Francuska krajem 1995 godine, počinitelji genocida su bili nagrađeni sa 49% teritorije Bosne i Hercegovine, takozvanom Republikom Srpskom, u koju je bila uključena i stavljena pod njihov tzv. suverenitet i Srebrenica, cime su agresori nagrađeni vlašću nad žrtvama genocida u Srebrenici.

Prema Povelji Ujedinjenih nacija, Ujedinjene nacije su bile dužne da zaštite svoju članicu Republiku Bosnu i Hercegovinu od agresije i genocida, a ne da nagrade počinitelje genocida sa teritorijom države žrtve agresije.

GENOCID

Genocid je počinjen u Srebrenici. Na temeljima tog genocida , dejtonski sporazum i Republika Srpska su nelegalno uspostavljeni.

U nekoliko procesa pred Internacionalnim tribunalom za zločine na teritoriji bivše Jugoslavije u Hagu, taj sud je potvrdio da je u Srebrenici počinjen zločin genocida, na primjer u presudama generalu Krstiću i pukovniku Blagojeviću.

Glavni tužilac Carla Del Ponte i predsjednik tog suda sudija Theodor Meron potvrdili su da se u Srebrenici dogodio genocid prilikom njihovog nastupa na Savjetu sigurnosti UN, nešto manje nego mjesec dana prije desetogodišnjice genocida u Srebrenici iz 1995.

U 2005. godini Kongres Sjedinjenih Američkih Država usvojio je rezoluciju kojom potvrđuje da je u Srebrenici počinjen genocide.

Kristalno jasno, 27. februara 2007. godine, Internacionalni sud pravde je donio svoju odluku u slučaju Bosna i Hercegovina protiv Srbije i Crne Gore po kojoj je Sud presudio: “Da je Srbija prekršila obavezu da spriječi genocid na što je bila obavezna na osnovu Konvencije o sprečavanju i kažnjavanju zločina genocida, koji se odnosi na genocid počinjen u Srebrenici u julu 1995. godine.” Sud je potvrdio da je genocid počinila vojska Republike Srpske i da je Srbija imala obavezu da to spriječi.

Žrtve genocida i dalje ugnjetavane od strane svojih dželata

Institucije vlasti koje sada imaju najvitalniju ulogu u Srebrenici su sve u Banja Luci, glavnom gradu “Republike Srpske”, što znači da je sada vlast nad narodom Srebrenice u rukama onih koji su počinili genocid. Kao rezultat, narod Srebrenice nema niti najosnovnija prava te je konstantno izložen “tihom” genocidu koji se provodi perfidnim metodama vlasti.

Osim toga, poratni Zakon o dvojnom državljanstvu u Bosni i Hercegovini, proglašen 23. decembra 1997. godine od strane UN Visokog predstavnika za BiH Carla Westendropa, i primjenjen već 1. januara 1998. godine ide u pravcu finalizacije genocida koji se dogodio u Srebrenici. Ovaj zakon oduzima Bosansko državljanstvo od žrtava genocida ukoliko su prihvatili državljanstvo države koja ih je prihvatila kao izbjeglice. Ovim zakonom se pokušava postići ono što agresorima nije pošlo za rukom da postignu silom i genocidom. Cilj je da se narod Srebreničane zauvijek protjera od svojih domova.

Kada se jednom obavi popis stanovništva, etnička struktura Bosne i Hercegovine će biti zauvjek promijenjena što će dovršiti ciljeve genocida – narod Srebrenice biće permanentno “etnički očišćen”. Zato, Mi, narod Srebrenice, zadržavamo naše BiH državljanstvo u skladu sa Ustavom i zakonima Republike Bosne i Hercegovine.


NOVI USTAV BOSNE I HERCEGOVINE I REPUBLIKA SRPSKA NIKADA NISU BILI NITI SU SADA LEGALNI

Ustav Republike Bosne i Hercegovine nikada nije odbačen, jer Aneks 4 dejtonskog sporazuma, koji sadrži novi ustav Bosne i Hercegovine, nikada nije prošao legalnu proceduru usvajanja novog ustava predviđenu Ustavom Republike Bosne i Hercegovine, pa je stoga nevažeći kao ustav države.

Osim toga, prema Konvenciji o sprečavanju i kažnjavanju zločina genocida, genocid ne može biti temelj za kreiranje nove države i novog ustava.


POTOČARI - ZASTAVE REPUBLIKE BOSNE I HERCEGOVINE


PONOVO USPOSTAVLJENI ZAKONI I USTAV REPUBLIKE BOSNE I HERCEGOVINE


Postojeće stanje u Srebrenici nije ništa drugo nego pokušaj da se legalizuje počinjeni genocid.

Stoga, od __ marta 2007. godine, Ustav i zakoni Republike Bosne i Hercegovine se ponovo uspostavljaju, a vlast genocidne Republike Srpske prestaje da vrijedi u Opštini Srebrenica.

Na području Opštine Srebrenica će se primjenjivati odgovarajući zakoni Republike Bosne i Hercegovine kojima smo uvijek bili lojalni. Primjena Ustava i zakona Republike Bosne i Hercegovine će se nastaviti dok god se ne uspostavi novi legitimni Ustav Bosne i Hercegovine. Do tada, Srebrenica će biti poseban distrikt u državi Bosni i Hercegovini, koji će biti upravljan Ustavom i zakonima Republike Bosne i Hercegovine.

Skupština Opštine Srebrenica će u budućnosti prema potrebi usvajati propise u skladu sa Ustavom i zakonima Republike Bosne i Hercegovine.

3. ONLY THE PARLIAMENT OF THE MUNICIPALITY OF SREBRENICA HAS AUTHORITY TO DECLARE INDEPENDENCE FROM GENOCIDAL "REPUBLIKA SRPSKA" - NOBODY ELSE IN THE WORLD HAS SUCH AUTHORITY - Translation of 1.

Only the Parliament of the Municipality of Srebrenica has the legal authority to declare independence from the genocidal "Republika Srpska" based on the judgment of the International Court of Justice from February 26th, 2007. No other institution in the world has such legal authority – not the Security Council of the United Nations, and not the institutions of the Dayton Bosnia and Herzegovina, including the Parliament of the Dayton Bosnia and Herzegovina.

No institution in the world, including institutions of the Dayton Bosnia and Herzegovina created by the aggression and genocide, can legally prevent nor deny the right of the Municipality of Srebrenica to reinstate legal status as it was before the aggression and the genocide. These rights are provided by the final judgment of the International Court of Justice on February 26, 2007 against Serbia and genocidal "Republic Srspka." This is what Prof. Francis A. Boyle and Carla Del Ponte achieved to provide for Bosnia and Herzegovina at the International Court of Justice and International Criminal Tribunal for the Former Yugoslavia.

Anyone who claims that somebody else in the world has the authority to make this decision in the name of Srebrenica, and not the Parliament of the Municipality of Srebrenica, is ignorant or traitor, including those politicians who pretend that they represent interest of people of Srebrenica, putting all responsibilities for the future of Srebrenica and Bosnia and Herzegovina into hands of some abstract world and doing everything to disrupt the Parliament of the Municipality of Srebrenica to legitimately declare independence of the Municipality of Srebrenica from genocidal "Republic Srpska."

Upon the request from the officials of the Municipality of Srebrenica, Prof. Boyle, the father of the lawsuit of the Republic Bosnian and Herzegovina at the International Court of Justice against Serbia and Montenegro for aggression and genocide in Republic of Bosnia and Herzegovina, prepared "DECLARATION OF INDEPENDENCE OF SREBRENICA, MUNICIPALITY OF THE REPUBLIC OF BOSNIA AND HERZEGOVINA." Per request of the officials of the Municipality of Srebrenica, a full text of the Declaration follows in English and Bosnian language.




4. DECLARATION OF INDEPENDENCE OF SREBRENICA, MUNICIPALITY OF THE REPUBLIC OF BOSNIA AND HERZEGOVINA - Translation of 2.

The Parliament of the Municipality of Srebrenica in the session of the Parliament held in Srebrenica on March ----, 2007, declares that from this date forward, Srebrenica is an INDEPENDENT MUNICIPALITY OF THE REPUBLIC OF BOSNIA AND HERZEGOVINA in Bosnia and Herzegovina.

Pursuant to the plan to carve up the Republic of Bosnia and Herzegovina in the General Framework Agreement for Peace in Bosnia and Herzegovina, officially signed in Paris in December 1995 (“Paris Agreement”), Srebrenica and its people were sacrificed. Genocide was committed against the people of Srebrenica. This has been confirmed by the International Court of Justice in its decision of February 26, 2007, where it found that Serbia failed to prevent genocide in Srebrenica commited by the Army of Republika Srpska.

The Paris Agreement and Republika Srpska that it created were built on the genocide committed in Srebrenica. Without the genocide in Srebrenica there would be no Paris Agreement and therefore, the resulting Paris Agreement is illegal and invalid. Republika Srpska, which was formed based on the Paris Agreement is therefore a genocidal statelet without any legal basis. Since both have always been genocidal we repudiate both. Therefore, we the people of the Municipality of Srebrenica declare our independence from this genocidal Republika Srpska and the Paris Agreement. We have always and still remain loyal to the Republic of Bosnia and Herzegovina. Our sole loyalty is to the Republic of Bosnia and Herzegovina and its Constitution. Therefore, we reinstate the laws and the Constitution of the Republic of Bosnian and Herzegovina.

The Republic of Bosnia and Herzegovina was never legally terminated, and it is for this reason that we recognize that the Republic of Bosnia and Herzegovina and its Constitution are still in force here in Srebrenica. We, the people of Srebrenica, will be applying the laws and constitution, and flying the flag of the Republic. We will be a part of the State of Bosnia and Herzegovina like Brcko District, but will be applying the laws of the Republic of Bosnia and Herzegovina.

HISTORY

From the beginning of the aggression on the Republic of Bosnia and Herzegovina in April 1992, until February 1993, the defense forces of the Republic in Srebrenica successfully resisted the aggression from Serbia and Montenegro (the rump Yugoslavia). In that period, it is estimated that about 1800 residence of Srebrenica, mostly civilians, died as victims of “ethnic cleansing.” Subsequent to a major offensive carried out by three corps of the Yugoslav Peoples Army (JNA) at the beginning of February 1993, UNPROFOR forces came to Srebrenica. The UN Security Council adopted Resolution S/RES/819 by which Srebrenica was proclaimed a UN Protected Zone, and at the same time a demilitarization agreement was signed. Unfortunately “demilitarization” practically meant the disarming of the defenders of Srebrenica, and not the forces of the aggressor.

The result of disarming Srebrenica is that in July 1995, the UN Protected Srebrenica became the largest killing site in Europe since World War II, and about 8,500 men, women, and children were brutally murdered there.

Subsequently, through the “General Framework Agreement for Peace in Bosnia and Herzegovina” which was agreed upon in Dayton, Ohio in the United States, and of which the official and final version was signed in Paris, France at the end of 1995, the perpetrators of genocide were rewarded with 49% of the territory of Bosnia and Herzegovina – the so-called “Republika Srpska” – in which was included their so-called sovereignty over Srebrenica, thereby granting the aggressors power over the victims of genocide.

By the UN Charter, the United Nations were obligated to protect its member state, the Republic of Bosnia and Herzegovina, from aggression and genocide, and not to reward the perpetrator of genocide with territory of the victim state.

GENOCIDE

Genocide occurred in Srebrenica. It is on this genocide that the Paris Agreement and Republika Srpska were illegally built.

In several criminal prosecutions before the International Criminal Tribunal for the Former Yugoslavia at the Hague, the court has confirmed that the crime of genocide occurred in Srebrenica, e.g. judgments in the cases of General Krstic, Colonel Blagojevic.

Chief Prosecutor Carla Del Ponte and ICTY President Judge Theodor Meron acknowledged the genocide in Srebrenica when they appeared before the Security Council less than a month before the 10th Anniversary of the 1995 genocide in Srebrenica.

In 2005, the United States Congress adopted a resolution acknowledging that genocide was committed in Srebrenica.

Most decisively, on February 27, 2006, the International Court of Justice rendered its decision in the case of Bosnia and Herzegovina v. Serbia and Montenegro and announced that the Court: “Finds that Serbia has violated the obligation to prevent genocide, under the Convention on the Prevention and Punishment of the Crime of Genocide, in respect of the genocide that occurred in Srebrenica in July 1995.” The Court confirmed that genocide was committed by the Army of Republika Srpska and that Serbia had an obligation to prevent it.

Victims of Genocide are still suffering at the hands of their killers

The governing bodies that are currently responsible for the most vital aspects of Srebrenica are in Banja Luka, the capitol of Republika Srpska, which means that power over the people in Srebrenica is in hands of those who committed the genocide. As a result, the people of Srebrenica are unable to exercise their most basic rights and are constantly subjected to “quiet” genocide carried out through insidious methods.

Furthermore, the post war dual citizenship legislation in Bosnia and Herzegovina, proclaimed by then UN High Representative in B&H, Carl Westendrop, on December 23, 1997, and enacted on January 1, 1998 seeks to finalize the genocide that occurred in Srebrenica. This legislation strips the survivors of genocide of Bosnian citizenship if they have accepted citizenship of the country that hosted them as refugees. This legislation seeks to accomplish through law what the aggressors could not accomplish through force and genocide. It seeks to forever and permanently remove the Srebrenica people from their home.

Once a census takes place, the ethnic structure of Bosnia and Herzegovina will forever be changed and this will finalize the goals of genocide—the people of Srebrenica will be permanently “ethnically cleansed.” Therefore, We, the people of Srebrenica, still claim our citizenship under the Constitution and laws of the Republic of Bosnia and Herzegovina.


THE NEW CONSTITUTION & REPUBLIKA SRPSKA WERE NEVER, NOR ARE THEY NOW LEGAL

The Constitution of the Republic of Bosnia and Herzegovina was never abandoned. Annex 4 of the Paris Agreement, which contains a new constitution of Bosnia and Herzegovina, never passed through the procedures mandated by the Constitution of the Republic of Bosnia and Herzegovina, and therefore, as a constitution it is invalid.

Furthermore, according to the Convention on the Prevention and Punishment for the Crime of Genocide, genocide cannot be the basis for creating a new state and constitution.

THE LAWS AND CONSTITUTION OF THE REPUBLIC OF BOSNIA AND HERZEGOVINA RE-INSTATED

The existing state of matters in Srebrenica is nothing more than an attempt to legalize the genocide that occurred.

Therefore, from this day of March __, 2007, the laws and Constitutional of the Republic of Bosnia ad Herzegovina are reinstated and the powers of the genocidal Republika Srpska cease to apply in the Municipality of Srebrenica.

The area of the Municipality of Srebrenica will be ruled by the valid laws of the Republic of Bosnia and Herzegovina, to which we have always remained loyal. The application of the laws and Constitution of the Republic of Bosnia and Herzegovina will continue until a new, legitimate Constitution of the Republic of Bosnia and Herzegovina is established. Until then, Srebrenica will be a separate district in the State of Bosnia and Herzegovina, but will be governed by the Constitution and Laws of the Republic of Bosnia and Herzegovina.

The Parliament of the Municipality of Srebrenica will in the future as necessary enact laws consistent with the Constitution and the laws of the Republic of Bosnia and Herzegovina.
